The Definition of the Supreme Court and Its Obligations and Authorities – In a country, there must be a legal entity that specifically handles problems related to violations of existing laws.
Violations of law can be in the form of violations of existing prohibitions within the State that are carried out intentionally by someone. The violation can have fatal consequences and can harm other people, therefore it is prohibited by the State.
The Definition of the Supreme Court and Its Obligations and Authorities
The body that can enforce the law in the State of Indonesia is the supreme court which will be able to weigh and give punishment or sanctions to anyone who violates the law. In order to understand what a supreme court is, it will be explained as follows.
Definition of the Supreme Court
The Supreme Court is a State institution of the highest judicial body which can supervise a judicial body in the environment general court, within the military court, within the religious court, and within the state administrative court. The Supreme Court or what is referred to as the MA is domiciled in the State capital.
Because of the three amendments to the 1945 Constitution regarding judicial power in Indonesia, which can be exercised by the supreme court and also the constitutional court. The composition of the supreme court itself consists of a chairman, member judges, clerks, and also a secretary. The Chief Justice of the Supreme Court who can be elected from and by the Supreme Court justices who can then be directly appointed by the President.
In the supreme court there are justices who have a maximum of 60 people. Supreme Court justices can come from the career system of judges, or it can also be based on a career system that comes from professionals or academics. Candidates for independent magistrate judges can be proposed by the Judicial Commission which is addressed to the DPR which will then get approval and will be appointed as supreme justices by the president.
Obligations and Authorities of the Supreme Court
The duties and powers possessed by the supreme court are:
- Can have authority in adjudicating at the cassation level, can test a regulation existing legislation under the law, and also has other powers that have been granted by Constitution.
- Can nominate 3 people who will become members of the constitutional judges.
- Can provide consideration in terms of the president granting clemency and rehabilitation.
