Illegal levies (Pungli) are actions carried out by a person or civil servant or state official by requesting payment of money that is not appropriate or there are no rules relating to payment the. This is usually equated with acts of extortion, fraud or corruption.

According to Wikipedia, illegal levies are the imposition of fees in places where fees should not be charged or collected. Often extortion is carried out by officials or government officials.

Factors Causing Illegal Levies (Extortion)

There are several factors that cause someone to commit extortion, including:

  • Abusing authority. A person's position or authority can cause violations of discipline by perpetrators who commit illegal levies.
  • Mental Factors. A person's character or behavior in acting and exercising control over himself.
  • Economic Factors. Income that can be said to be unable to meet the necessities of life which is not commensurate with the duties/position that a person is carrying out creates an incentive to commit extortion.

The Crime of Illegal Levies (Extortion)

In criminal cases of illegal levies, it is not specifically stated in the Criminal Code, however illegal levies are can be equated with criminal acts of fraud, extortion and corruption which are regulated in the Criminal Code, among others other:

Article 368 of the Criminal Code
Anyone who, with the intention of unlawfully benefiting himself or another person, forces another person by force or threat of force to give something goods, all or part of which belong to another person or an attempt to provide a debt or write off a receivable, is threatened, for extortion, with a maximum imprisonment of nine year.

Article 415 of the Criminal Code
A civil servant or other person who is given the task of carrying out a public office continuously or temporarily intentionally embezzling money or securities held because of his position or allowing money or securities to be taken or embezzlement committed by another person or assisting as an accomplice in committing such an act, is punishable by a maximum prison sentence seven years.

Article 418 of the Criminal Code
A civil servant who receives a gift or promise even though he knows or should reasonably suspect that the gift or promise was given because power or authority related to his position is punishable by a maximum imprisonment of six months or a maximum fine of four thousand five hundred rupiah.

Article 423 of the Criminal Code
The civil servant in question benefits himself or others unlawfully by abusing his power to force others to hand over something making a payment, making a deduction from a payment or carrying out work for oneself, shall be punished by imprisonment for a maximum of six year.

From the criminal provisions above, the crime of illegal levies can be charged with the following criminal offenses:

Fraud Crime
Fraud and illegal levies are criminal acts where there are the same and interrelated elements, among others, for personal gain himself or another person unlawfully by a series of lies to or so that another person gives goods or something else to her.

Crime of Extortion
Fraud or extortion is a criminal act in which there are elements and they are interrelated, among other things, to benefit oneself or other people by violating the law with a series of violence or by threatening other people to hand over goods or things to her.

Corruption Crime
The criminal act of corruption is very closely related to crimes of office, because the formulation in Article 415 of the embezzlement article in the Criminal Code was adopted by law. No. 31 of 1999 which was subsequently revised by Law no. 20 of 2001 which is contained in article 8.
