Definition of Local Government

Regional government is an implementation in the field of government by the regional government and the Regional People's Representative Council based on the principle of autonomy and co-administration which applies the principle of broadest autonomy to the system and principles of the Unitary State of the Republic Indonesia.

Another definition of Regional Government is the implementation of regional government functions carried out by local government institutions, namely the Regional Government and the Regional People's Representative Council (DRPD).

According to UUD No. 32 of 2004 Article 1 paragraph 1, Regional Government, namely government affairs by the regional government and DPRD according to the principle of autonomy and as well as assistance with the principle of broadest autonomy with the system and also the principles of the Unitary State of the Republic of Indonesia as referred to in the 1945 Constitution of the Republic of Indonesia.

Whereas in Article 1 paragraph 3 of Law no. 23 of 2014. The regional government is the head of the region as an element of the organizer of the Regional Government who leads in the course of government affairs which becomes an authority of the autonomous region.

Characteristics of Local Government

J. Oppenheion states that there are characteristics of local government, namely:

The existence of an environment or an area that has boundaries that are smaller than the country.
There is enough population
Having interests that are taken care of by the State but related to the environment makes it possible for residents to move together in an effort to be self-supporting.
Have an adequate organization for the implementation of such interests
Have the ability to provide the necessary costs.

There are conditions for the formation of a local government, namely:

Socio-cultural

Size of area as well as other potential considerations
Implementation of a regional autonomy

Regional Governance Principles

According to Article 58 of Law no. 23 of 2014, in implementing the government must have guidelines on the general principles of implementing state government, namely:

Regional Government Duties and Authorities

According to Article 65 of Law no. 23 of 2014, the duties of regional governments or regional heads are as follows:

As the leader of the course of government affairs who have regional authority in accordance with statutory provisions and policies determined jointly with the DPRD.
Maintaining peace and public order
Compile and also submit a draft regional regulation on APBD, draft regional regulation on changes to APBD, the draft Perda on the accountability of running the APBD to a DPRD which will then be discussed together.
Not only that, the Regional Head also has the task of representing his region inside and outside court, and may appoint an attorney to represent him according to statutory provisions legislation.
The regional head has the task of proposing the appointment of a deputy regional head
Another task of the regional head is the implementation of tasks in accordance with statutory regulations

According to Article 65 paragraph 2 of Law no. 23 of 20014, the authority of a regional head is:

Submitting draft Perda
Carry out certain actions in urgent conditions and are required by the region and the community
Establish regional regulations that have obtained joint approval from the DPRD
Establish Regional Head Decree Decrees

Rights and Obligations of Local Government

Based on Law no. 23 of 2014, regional heads have the following rights:

Carry out regional wealth management
Organize and manage their own government affairs
Obtaining other legitimate sources of income
Collection of local taxes and also regional redistribution
Perform management of regional apparatus
Choose regional leaders
Obtain profit sharing from a management of natural resources as well as other resources that are appropriate in the area
Obtain other rights that have been arranged. It also includes basic salary, protocol rights, position allowances and other benefits.

As for the obligations of local government according to Article 67 of Law no. 23 of 2014 are:

Running a national strategic program
Carry out the development of democratic life
Hold firmly and also practice Pancasila, implement the 1945 Constitution of the Republic of Indonesia and also be able to maintain the integrity of the Unitary State of the Republic of Indonesia.
Running a national strategic program
Establish relationships with all vertical agencies in the region and also all regional apparatus
